Terms of use for Candidates

This document contains the Terms of Use applicable to the services offered by HIREFLIX, S.L. for candidates. You represent that you have read and understand the conditions set forth herein and that:

  • It assumes all obligations set forth herein.
  • If you do not understand or have any doubts about this document, please contact HIREFLIX in writing to resolve them.

1. THE PARTIES

The party providing the services is HIREFLIX, S.L. (hereinafter, "HIREFLIX"), with Tax Identification Number B-67189183 and registered office at Travessera de Gracia, 15 - floor sob, door 2, 08021 Barcelona, Spain, a company registered in the Barcelona Mercantile Register in Volume 46365, Folio 95, Page B-517676.

The contracting party of the services is the User, who has accepted these Terms of Use.

2. DEFINITIONS

For the correct reading and interpretation of these Terms of Use, the following words are given the meanings described here::

  • Candidate: The natural person who uses HIREFLIX Services.
  • Services: online video interview activity provided by HIREFLIX and contracted by the User.
  • Service Provider: HIREFLIX is the legal entity that provides or performs the Services.
  • User: the person who asks the questions through the HIREFLIX Services in order to conduct the interview of the Candidate and who pays HIREFLIX for it.

3. SCOPE OF THE TERMS OF USE

These Terms of Use shall apply to the HIREFLIX Services used by the Candidate.

4. REQUIREMENTS FOR THE USE OF THE SERVICES

The requirements to be able to use the Service are:

  • Accept these Terms of Use.
  • In order to use the Service it will be necessary to have a device with Internet access. Such Internet access may generate a data connection consumption and may entail a cost for the Candidate, who is solely responsible for such consumption. The Candidate understands that if the device from which he/she wishes to contract a Service does not have a connection, he/she will not be able to use the Services.

5. RULES FOR THE USE OF THE SERVICES

The Candidate undertakes to use the Services and all their content in accordance with the law, morality, public order and these Terms of Use, and not to use them for illegal or criminal activities that infringe the rights of third parties and/or violate any rules of the applicable legal system. The Candidate undertakes to:

  • Not to introduce or disseminate content or propaganda of a racist, xenophobic, pornographic or terrorist nature or that violates human rights.
  • Not to introduce or disseminate on the network data programmes (viruses and harmful software) likely to cause damage to the computer systems of the access provider, its suppliers or third party users of the Internet network.
  • Not to disseminate, transmit or make available to third parties any type of information, element or content that violates the fundamental rights and public freedoms recognised in the constitution and in international treaties.
  • Not to disseminate, transmit or make available to third parties any type of information, element or content that constitutes unlawful or unfair advertising.
  • Not to transmit unsolicited or unauthorised advertising, advertising material, "junk mail", "chain letters", "pyramid structures", or any other form of solicitation, except in those areas (such as commercial spaces) that have been exclusively conceived for this purpose.
  • Not to introduce or disseminate any false, ambiguous or inaccurate information and content in a manner that is misleading to the recipients of the information.
  • Not to impersonate other Candidates by using their registration keys on the Services.
  • Not to disseminate, transmit or make available to third parties any type of information, element or content that violates the intellectual and industrial property rights, patents, trademarks or copyrights of the owners of the Service or third parties.
  • Not to disseminate, transmit or make available to third parties any type of information, element or content that involves a violation of the secrecy of communications and personal data legislation.
  • Not to respond to interviews with the aim of "testing" the Services with the intention of copying or being inspired by the same.
  • The Candidate undertakes to indemnify HIREFLIX against any possible claim, fine, penalty or sanction that HIREFLIX may be obliged to bear as a consequence of the breach by the Candidate of any of the above mentioned rules of use, and HIREFLIX reserves the right to request the corresponding compensation for damages.

6. CANDIDATE

The Candidate shall use the Services for his/her own use and, if ever permitted to create a registration, the Candidate is responsible for maintaining the confidentiality of the account and password details and for restricting access to his/her Internet access device. The Candidate is also responsible for maintaining the confidentiality of the personal data of third parties with whom he/she comes into contact through the use of the Services. To the extent permitted by applicable law, the Candidate is solely responsible for maintaining control of his/her account access data and understands and agrees that all transactions made with his/her username and password are binding.

The Candidate may not use the Services for purposes other than those contemplated in these Terms of Use.

HIREFLIX may deny access to the Service, terminate any account and delete or modify any data if the Candidate fails to comply with applicable law, these Terms of Use or any other applicable terms and conditions or policies.

7. USE OF THE SERVICES

The steps are as follows:

  • Click on "Start Interview" on an interview page.

8. PRICE AND PAYMENT METHODS

Use of the Hireflix Services is free of charge to Candidates.

9. LIMITATION OF LIABILITY. EXCLUSION OF WARRANTIES.

Content of the Services

The Services offered by HIREFLIX are intended for explicit and specific uses and purposes. HIREFLIX shall not be liable in the event that the Candidate's expectations of the Services are frustrated, having been attributed other uses or purposes that have not been fulfilled at the end of the Services.

Devices and browsers

HIREFLIX is not responsible for any possible damage that may occur due to the use of devices with defective Internet access or outdated versions of browsers, or as a result of the malfunction of the device or browser.

10. INTELLECTUAL AND INDUSTRIAL PROPERTY

The intellectual and industrial property rights over the Service and its contents (including, but not limited to, texts, documents, photographs, graphics, images, icons and design) are the property of HIREFLIX, and none of the intellectual or industrial property rights over them may be considered to be assigned to the Candidate.

Where technically possible, in the event that the Candidate provides any opinion, assessment or content through the Service, he/she declares that he/she is the owner of the rights to such content or has the necessary authorisation or licence from its owner and expressly declares that he/she does not infringe the rights of any third party.

The interview conducted by the Candidate through the HIREFLIX Services will be transferred to the User. The Candidate also agrees that HIREFLIX may analyze the Candidate's interview with the sole purpose of improving the product and to provide a better service.

11. DATA PROTECTION

The collection of personal data provided by the Candidate to HIREFLIX is strictly marked in the provision of services between HIREFLIX and the User. In this regard, HIREFLIX acts merely as a data processor, and therefore in no case determines the purposes of the processing of the data it collects, but complies with the instructions of the data controller. Notwithstanding the foregoing, HIREFLIX reserves the right to contact the Candidate for the sole purpose of requesting feedback on the interview. The legal basis for this processing is the legitimate interest of HIREFLIX in being able to provide a higher quality of Services.

HIREFLIX will only process Candidates' data (in aggregate form and in no case personalised) for statistical analysis purposes.

12. INVALIDITY OR INEFFECTIVENESS

The declaration of nullity or ineffectiveness of all or part of any clause included in these Terms of Use shall only affect such clause or the part of it that is null or ineffective, and these Terms of Use shall survive in all other respects, and such provision shall be deemed not to be included in whole or in part, unless the clause is essential.

13. APPLICABLE LAW AND COMPETENT JURISDICTION

These Terms of Use shall be governed by and construed in accordance with Spanish law.
